Moral Components of Justice and Equality of Presidential Election Candidates in the Constitution of Iran and Iraq

Background: The issue of the relationship between morality and politics is one of the fundamental issues of political philosophy that has been of interest in all historical periods, and many thinkers and philosophers have tried to explain the compatibility or incompatibility of these two categories. The present study was conducted with the aim of examining the moral components of justice and equality of presidential election candidates in the constitution of Iran and Iraq.
Conclusion: It is important to note that the belief in the relationship between morality and politics determines the type of action and politics of officials and people in a society. The main claim of this doctrine is that one should distinguish between the rules of morality and the requirements of politics and take political action based on reality and taking into account interests and interests. According to this approach, paying attention to morality in politics leads to failure in the political arena. The most important commentator on this approach was Nicola Machiavelli, who, although he considered morality essential to the lives of individuals, considered adherence to it dangerous for statesmen. Article (115) of the Iranian Constitution, in stating the conditions for presidential candidates, basically contains positive traits and conditions. Someone who has the moral conditions of “good record, honesty and piety” certainly does not have a criminal record and has not committed any crime against electoral laws. The Iraqi Constitution also talks about the president in two months of 66 and 75 and introduces him as a symbol of the unity and sovereignty of the country and a protector of the constitution and the homeland. It should be noted that the Iranian and Iraqi constitutions have stipulated conditions and limitations for presidential candidates that are either not stipulated for candidates for other elected positions, including representatives, or are somewhat different from their conditions for candidacy.
