Ethical Foundations in the Implementation of Women's Criminal Sentences from the Perspective of Iranian Jurisprudence and Law

Background: In Iranian jurisprudence and law, as there is a relationship between crime and gender, this relationship can also be seen in the implementation of punishment. Therefore, the present research aims to examine the moral foundations of the execution of punishments for women in Iranian laws and to present specific criminal sentences for women in connection with publicity, exile, homosexuality, apostasy, the quality of the execution of the limit, the place of detention of convicts and the delay in punishment in He has paid attention to the special conditions that have been established with regard to ethical principles.
Conclusion: One of the important issues and attention of the international community is respect for the rights of men and women and non-discrimination based on gender. The results of the research indicate that in Iranian law, punishment for women has been tried based on the two principles of looking at women's dignity and observing justice. In order to achieve this goal in the field of criminal law, protections for women's rights in the form of cases such as: exemption from paying dowry in cases of pure wrongdoing, delay in the execution of punishment, criminal protection for women in case of alimony and criminal protection for women in Testimony has taken place. But in relation to women's rights, legal gaps are also observed in Iran's criminal justice system, such as: women's rights regarding the proportionality of the age of criminal responsibility with reality, the absence of necessary legal protections regarding domestic violence against women, and legal gaps in Shape rules.
