Background: Disability, death and early retirement are not limited to the occurrence of a defect or illness in the insured person, but any process that leads to the inability of the person to do work can be included in this framework. Due to the importance of this, the present study was formed with the aim of legal and ethical analysis of early retirement, disability and death in hard and harmful jobs in Iranian law.
Conclusion: Is it simply moral to pay higher wages for more dangerous jobs? If the only reason someone gets a dangerous job is extra money, there is a moral dilemma, unless the job can be made safer and the necessary arrangements made to prevent and compensate for the damage. Given that hard-working employees are entitled to compensation and early retirement in the event of an accident, the legal system in Iran provides for only minor arrangements for early retirement and disability. Accidents that occur while on the job are covered by insurance under Article 60 of the Social Security Act, and related health and medical services are provided to the victim by the Social Security Administration. As a result; According to Article 6 of the Civil Liability Law; In case of death, language damage includes all costs, especially burial costs. Harmful has ambiguities and inconsistencies that complicate its implementation in practice.
