fa اصل اخلاقی احترام به حقوق مکتسبه و اعتبار بین المللی آن در حقوق ایران تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">حق مکتسب یک اصل اخلاقی اساسی و امتیازی است که اشخاص به موجب قرارداد و قانون به دست می‌آورند و در صورت عدم تغییر قوانین، از بین نمی‌روند. مفهوم حق مکتسب ابزاری برای دستیابی به عدالت در حقوق است. حقوق مکتسبه تأثیر بین‌المللی دارد؛ این تأثیرات در زمینه اموال و ارتباطات احوال شخصی، حوزه‌های بازرگانی، تجارت و مالکیت معنوی است. پزوهش حاضر با هدف بررسی اصل اخلاقی احترام به حق مکتسب و اعتبار بین المللی آن در حقوق ایران شکل گرفته است.</span></span><span dir="LTR" style="line-height:90%"><span style="font-family:&quot;Arial&quot;,sans-serif"></span></span></span></span></span></span></span><br> <b><span dir="RTL" lang="AR-SA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">نتیجه گیری:</span></span></span></b><span dir="RTL" lang="AR-SA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">&nbsp; حقوق مکتسبه را نمی توان از شهروندان باز پس گرفت. این حقوق تنها در قلمرو حاکمیت کشور صادر کننده قابلیت اجرا دارد و هرگاه حقی ایجاد شود و در کشوری به جز محل ایجاد آن تقاضای تأثیر و شناسایی آن حق گردد مسأله ای به نام تعارض متحرک مطرح می شود. در واقع تعارض های متحرک همان شناسایی بین المللی حقوق مکتسبه و یا تأثیر بین المللی حقوق است</span></span></span><span style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;Arial&quot;,sans-serif">.</span></span></span><span dir="RTL" lang="AR-SA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;"> بنابراین اجرای حقوق مکتسبه نیازمند همکاری هر چه نزدیک تر کشورها در زمینه های حقوقی و قضایی است. سیاست ایران در این زمینه بر پایه رفتار متقابل استوار گردیده و احکام صادره از کشورهایی که در مورد احکام صادره از محاکم ایران معامله متقابل کنند ، در ایران قابل اجراست.</span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">Acquired right is a fundamental moral principle and a privilege that people obtain by contract and law and will not be lost if the laws are not changed. The concept of acquired right is a tool to achieve justice in law. Acquired rights have an international impact; These effects are in the field of property and communication of personal status, business, trade and intellectual property. The current thesis was formed with the aim of examining the moral principle of respect for acquired rights and its international validity in Iranian law.</span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span style="font-size:10.0pt">Conclusion</span></b><span style="font-size:10.0pt">: Acquired rights cannot be taken back from citizens. These rights are enforceable only in the territory of the issuing country&#39;s sovereignty, and whenever a right is created and, in a country, other than the place where it was created, the effect and recognition of that right is demanded, an issue called moving conflict is raised. In fact, dynamic conflicts are the international recognition of acquired rights or the international impact of rights. Therefore, the implementation of acquired rights requires countries to cooperate as closely as possible in legal and judicial fields.
