other الزامات اخلاقی-قانونی پلیس ناظر بر اصل برائت در جرائم مواد مخدر در پرتو روانشناسی جنایی تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">زمینه: </span></span></b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">امروزه جرایم موادمخدر به‌عنوان یکی از اعمال مجرمانه که عموماً آثار آن دامنگیر اجتماع شده مورد شناسایی قرار گرفته است، لذا در راستای دادرسی عادلانه، اصل برائت در فرایند رسیدگی به جرایم موادمخدر مورد توجه قرار گرفت. با توجه به حاکمیت اخلاق بر قانون و ارتباط دوسویه آنها ضروری است الزاماتی خاص که حاکم بر نهاد کشف جرم در جرائم موادمخدر می&shy;باشد؛ در نظر گرفته شود. هدف از پژوهش پیش‌ رو ، تعیین الزامات اخلاقی- قانونی اصل برائت ناظر بر نهادهای دستگاه عدالت ‌کیفری در فرایند رسیدگی به جرایم مواد مخدر است. پژوهش حاضر از لحاظ هدف جزء تحقیقات کاربردی می‌باشد و از لحاظ شیوه جمع‌آوری اطلاعات به‌ روشی اسنادی و کتابخانه‌ای مورد بررسی قرار گرفته است.</span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">نتیجه گیری</span></span></b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;"> : درباب جرایم موضوع بحث شاهد تقدم اماره مجرمیت بر اصل برائت در مواردی چون کشت خشخاش و کوکا، مصادره وسایل حمل و نقل، مصادره و ضبط اموال قاچاقچیان موادمخدر بوده‌ایم. از منظر روانشناسی جنایی عوامل فردی مؤثر در وقوع جرم موصوف واجد اهمیت است که ناظر بر متهم بوده و نیروی پلیس را نیز در بر می‌گیرد. از نظر روانشناسی جنایی شخصیت متهم جرائم موادمخدر و خصوصیات فردی وی در وقوع جرم موصوف مورد توجه می‌باشد لذا ممکن است عدم رعایت حقوق موصوف ناظر بر متهم از منظر روانشناسی جنایی در نهایت باعث صدور حکم برائت گشته و به نوعی این الزامات در رعایت حقوق متهم و &nbsp;نیروی پلیس را در بر می‌گیرد.</span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:107%"><span style="font-family:Calibri,sans-serif"><b><span style="font-size:12.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif">Background: </span></span></span></b><span style="font-size:12.0pt"><span style="line-height:107%"><span style="font-family:&quot;Times New Roman&quot;,serif">Nowadays, drug crimes have been recognized as one of the criminal acts whose effects generally affect the community, so in order to have a fair trial, the principle of innocence was considered in the process of investigating drug crimes. Given the rule of ethics over the law and their two-way relationship, it is necessary to have special requirements governing the institution of crime detection in drug crimes. The purpose of this study is to determine the ethical-legal requirements of the principle of innocence of the institutions of the criminal justice system in the process of investigating drug crimes. From the perspective of criminal psychology, the individual factors influencing the occurrence of the crime are important, which supervises the accused and includes the police force.
