Role of Principles of Ethics in the Legal Function of Computer

Background: Despite the irreplaceable role of cyberspace in the behaviors of modern society and the importance of observing ethics in it, so far no research has been presented to build a model of practical ethics in this space. The present study examines how ethical laws are enacted in cyberspace.
Conclusion: By descriptive analysis of the concept of ethics in cyberspace, the perception is that ethics in modern space has four characteristics of self-control, universality, equality and unity. The realm of ethics in cyberspace is a world without borders. The principles of the supremacy of local law should not be taken into account and require new laws. For this reason, articles 3 of the Iranian electronic commerce law, 3 of the model electronic commerce law and 5 of the electronic communications convention are the basis for interpreting the law in cyberspace. This study indicates that the current laws governing cyberspace for some reason. Ethics are far removed from the laws of traditional law. Therefore, new structures are needed to legislate for cyberspace. In a way that enhances our understanding of the realities governing the legal functioning of the computer and obscures the silent, ambiguous, and conflicting aspects of modern law with traditional law. |
