fa مسئولیت اجتماعی پزشک با تأکید بر چالش های اخلاقی آن تخصصي Special پژوهشي Research <p dir="RTL" style="text-align: justify;"><strong><span style="font-family:b zar;"><span style="font-size:12.0pt;">زمینه:</span></span></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> سامانه‌های مسئولیت اجتماعی پزشک نقش مهمی در طبابت روزانه پزشکان و روابط آنها با بیماران دارد. این نظام‌ها به دو صورت مبتنی بر تقصیر و غیرمبتنی بر تقصیر، پایه‌گذاری می‌شوند. مبتنی بودن مسئولیت اجتماعی پزشک بر تقصیر، می‌تواند با بسیاری از ملاحظات اخلاق پزشکی در ارتباط باشد. بر این اساس در این پژوهش، چگونگی تأثیر هر یک از این سامانه‌ها، بر اجرایی شدن اصول و ارزش‌های اخلاق پزشکی مورد بررسی قرار گرفته است. برای این منظور، به تحلیل اخلاقی ابعاد مختلف قانون مسئولیت اجتماعی پزشک با استفاده از اصول چهارگانه اخلاق پزشکی و همچنین ملاحظات مربوط به رابطه پزشک و بیمار پرداخته می‌شود. </span></span></p> <p dir="RTL" style="text-align: justify;"><strong><span style="font-family:b zar;"><span style="font-size:12.0pt;">نتیجه‌گیری:</span></span></strong><span style="font-family:b mitra;"><span style="font-size:11.0pt;"> مسئولیت اجتماعی پزشک هر چه بیشتر به سمتی گرایش پیدا کند که عنصر تقصیر در آن کمرنگ‌تر شود، تأثیر بیشتری در به‌وجود آوردن فضای اخلاق و فضیلت در جامعه پزشکی دارد؛ طبیعت خصمانه، ایجاد تنش و استرس در رابطه پزشک - بیمار به واسطۀ طرح شکایت از پزشک، فضای قضاوت و سرزنش نسبت به خطای پزشکی و عدم جبران منصفانۀ خسارت بیماران از مهمترین چالش‌های اخلاقی سامانه‌های مسئولیت پزشکی مبتنی بر تقصیر می‌باشد.</span></span></p> <p><strong>Background:</strong> Medical liability systems play an important role on doctors&rsquo; everyday practices and their relationship with patients. They can be established in two ways, fault-based and non-fault. Basing medical liability upon the element of fault links it to various issues of medical ethics.&nbsp; In this paper, we have studied the possible ways each system, could affect the applicability of values and principles of medical ethics. In order to achieve that, we have ethically analyzed the different aspects of civil medical liability law, using the four medical ethics principles and the issue of physician-patient relationship.</p> <p><strong>Conclusion:</strong> The less prominent the element of fault in a medical liability system, the more it can succeed to apply ethical principles and hence to flourish the virtues and moral values in the medical society.&nbsp; Adversarial nature, creating stress and tension in physician-patient relationship due to patients&rsquo; complaints, a blame atmosphere toward medical errors and failure to provide access to fair compensation for medical injury, are among the most important ethical problems with the fault-based medical liability systems</p> مسئولیت اجتماعی پزشک, خطای پزشکی, اخلاق اصول محور, رابطۀ پزشک-بیمار Medical Liability, Medical Error, Principle-Based Ethics, Patient-Physician Relationship 0 0 http://ethicsjournal.ir/browse.php?a_code=A-10-24-26&slc_lang=fa&sid=1
