fa ابعاد اخلاقی مصرف و سوء مصرف مواد مخدر و وروان گردان ها و آسیب شناسی سیاست کیفری آن در ایران و عراق تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">مسائل اخلاقی زیادی پیرامون مصرف و سوء مصرف مواد مخدر وجود دارد و در یک جامعه واحد، ارزش‌ها و عقاید می‌توانند به‌طور قابل ملاحظه‌ای متفاوت باشند، که منجر به درگیری بر سر مسائل مختلف مربوط به سوء مصرف مواد شود. قوانین مواد مخدر در ایران و عراق هر دو تحت تأثیرهمین ارزش های اخلاقی و واقعیت‌های اجتماعی شکل گرفته‌اند . از این رو در مطالعه حاضر سعی شده ابعاد اخلاقی مصرف و سوء مصرف مواد مخدر و وروان گردان ها و آسیب شناسی سیاست کیفری آن در ایران و عراق&nbsp; مورد بحث قرار گیرد. &nbsp;</span></span><span dir="LTR" style="line-height:90%"><span style="font-family:"Arial",sans-serif"></span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">نتیجه گیری</span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">: سوء مصرف مواد هم یک موضوع شخصی و هم عمومی است و سوالاتی را در مورد حقوق فردی و مرزهای قانون و همچنین در مورد حاکمیت ملی و کنترل بین المللی ایجاد می کند. مسائل اخلاقی که تحت این عناوین مطرح می شوند ممکن است به برخی از مواضع اخلاقی گسترده مرتبط باشند. پیامدهای اتخاذ مفروضات فایده گرایانه ممکن است با اصول اخلاقی مبتنی بر نظریه حقوق فردی که ارتباط نزدیکی با نظریه طبیعت انسانی دارد، در تضاد باشد. هیچ یک از این دو موضع، فرض آزادیخواهانه علیه کنترل را توجیه نمی کند. در هر دو کشور، رویکردهای قانونی عمدتاً بر مجازات‌های سنگین متمرکز بوده است. در ایران، نظام حقوقی پس از انقلاب اسلامی به طور مشخص بر مبنای اصول اسلامی و با هدف حفاظت از کرامت انسان و مقابله با تهدیدات ناشی از اعتیاد و قاچاق مواد مخدر طراحی شده است. در عراق، اگرچه تاریخچه قانونی مرتبط با مواد مخدر از قوانین قدیمی و محدود شروع شده، ولی قانون جدید تصویب‌شده در سال ۲۰۱۷ با افزایش تعداد مواد قانونی و گسترش دامنه جرم‌انگاری نشان‌دهنده یک گام به جلو است. </span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">There are many moral issues surrounding drug use and abuse, and within a single society, values ​​and beliefs can differ considerably, leading to conflict over various issues related to drug abuse. Drug laws in both Iran and Iraq have been shaped by the same moral values ​​and social realities. Hence, the present study attempts to discuss the moral dimensions of drug use and abuse and its pathology in criminal policy in Iran and Iraq.</span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Conclusion</span></b><span style="font-size:10.0pt">: Drug abuse is both a personal and public issue, raising questions about individual rights and the boundaries of the law, as well as about national sovereignty and international control. The ethical issues raised under these headings may be relevant to some broad ethical positions. The consequences of adopting utilitarian assumptions may conflict with ethical principles based on the theory of individual rights, which is closely related to the theory of human nature. Neither of these two positions justifies the libertarian assumption against control. In both countries, legal approaches have focused primarily on severe punishments. In Iran, the post-Islamic Revolution legal system was specifically designed based on Islamic principles and aimed at protecting human dignity and confronting the threats posed by drug addiction and trafficking.
