fa ابعاد ساختاری-حقوقی بازداشت‌های طویل المدت و ملاحظات اخلاقی در این زمینه تخصصي Special پژوهشي Research <span style="font-size:11pt"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><b><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">زمینه:</span></span></b> <span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">بازداشت یا بازداشت موقت یکی از شدیدترین تصمیم‌های مراجع کیفری برای متهم است. در واقع در بازداشت موقت آزادی متهم گرفته می‌شود و او را در مکانی که از حقوق و آزادی‌های متعارف برخوردار نباشد، حبس می‌کنند.</span></span> <span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">از آنجا که قرار بازداشت موقت با اصل برائت و آزادی رفت‌وآمد افراد مخالف است و نتایج زیان‌بار آن غیرقابل‌جبران است، قانونگذار سعی کرده آن را از اختیار قاضی خارج و تحت قاعده و قانون تنظیم کند.</span></span> <span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">اما در عمل متاسفانه به کرات مشاهده می‌شود که این ظرفیت قانونی به جای اینکه برای امنیت جامعه مفید واقع شود موجبات ظلم و بی عدالتی فراوانی می‌شود. بنابراین در مطالعه حاضر محققان بر آن شدند تا ابعاد ساختاری-حقوقی در بازداشت‌های طویل المدت و</span></span> <span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">ملاحظات اخلاقی در این زمینه را مورد بررسی قرار دهند. </span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:Calibri,sans-serif"><b><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">نتیجه گیری:</span></span></b><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:"> بازداشت طولانی مدت غیر قانونی است و تبعات روانی متعدد مانند اضطراب ، افسردگی و حتی خودکشی را برای فرد بازداشت شده در بر دارد. برای جلوگیری از مخاطرات بازداشت موقت باید ملاحظات اخلاقی مانند: </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">احترام به حقوق بشر</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">، </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">ضرورت و تناسب</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">، </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">عدالت و بی‌طرفی</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">، </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">شفافیت و اطلاع‌رسانی</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">، </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">نظارت و بازبینی</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:"> و</span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">حمایت‌های اجتماعی و روانی مورد توجه قرار گیرد</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">. در خصوص بازداشت&shy;های غیر قانونی ، </span></span><span lang="AR-SA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:">دو عامل ساختاری و حقوقی در</span></span><span lang="FA" style="font-size:12.0pt"><span b="" mitra="" style="font-family:"> صدور قرار بازداشت موقت طولانی مدت غیر قانونی یا بی جهت مطرح هستند.&nbsp; </span></span></span></span></span></span></span><br> &nbsp; <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">Arrest or temporary detention is one of the most severe decisions made by criminal authorities for the accused. In fact, in temporary detention, the accused is deprived of his freedom and is imprisoned in a place where he does not enjoy normal rights and freedoms. Since the temporary detention order is contrary to the principle of innocence and freedom of movement of individuals and its harmful consequences are irreparable, the legislator has tried to remove it from the judge&#39;s authority and regulate it under the rule and law. However, in practice, unfortunately, it is often observed that this legal capacity, instead of being useful for the security of society, causes a lot of oppression and injustice. Therefore, in the present study, the researchers decided to examine the structural-legal aspects of long-term detentions and ethical considerations in this field.</span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Conclusion</span></b><span style="font-size:10.0pt">: Long-term detention is illegal and has numerous psychological consequences such as anxiety, depression, and even suicide for the detained person. To prevent the dangers of temporary detention, ethical considerations such as: respect for human rights, necessity and proportionality, justice and impartiality, transparency and information, monitoring and review, and social and psychological support should be taken into account.
