fa اخلاق و پاسخگویی در فضای مجازی با استفاده از قانون مسئولیت مدنی (مقایسه ایران و روسیه) تخصصي Special مروری Review Article <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">تفکر متعارف در مورد &quot;پاسخگویی&quot; باید فراتر از نسبت دادن صرف اعمال بدخواهانه و مجازات مرتکبین گسترش یابد و نباید اهداف سیاسی و فرقه ای مبنای رفتار قابل قبول قرار گیرد بلکه اخلاق که مفهومی جهان شمول است می بایست مبنای چنین افتراقی قرار گیرد. یکی از استنادها برای پاسخگو سازی قانون مسئولیت مدنی است. لذا در این پژوهش هدف پاسخ به این پرسش بوده است که اساساً مسئولیت مدنی که ابزاری مهم در حفط اخلاق و پاسخگویی است، در فضای مجازی چگونه محقق می‌شود و در این خصوص حقوق ایران و روسیه مورد قیاس قرار گرفت.</span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">نتیجه گیری:</span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:"> با توجه به اهمیت پاسخگویی از سوی همه اقشار در فضای مجازی می توان از قانون مسئولیت مدنی تا حدودی برای پاسخگو سازی افراد در این حوزه سود برد.&nbsp; نتایج و یافته‌های پژوهش در خصوص مقایسه مسئولیت مدنی در فضای مجازی بین ایران و روسیه &nbsp;موید این است که در حقوق ایران، با توجه به اینکه سازوکار اختصاصی نسبت به بروز مسئولیت مدنی در فضای مجازی وجود ندارد، با تکیه بر آموزه‌های کلی و سنتی مسئولیت مدنی، با توجه به عنصر تقصیر، می‌توان مسئولیت را به نحو تساوی یا تضامن بر اسباب متعدد تحمیل نمود، اما در حقوق روسیه، سازوکاری جداگانه در خصوص مسئولیت مدنی مالی و معنوی در فضای مجازی وجود دارد ، ضمن اینکه در تعدد اسباب نیز به مانند برخی از کشورهای دیگر اروپایی نظیر آلمان و فرانسه، به مسئولیت تضامنی بهای بیشتری داده شده است.</span></span><span dir="LTR" style="line-height:90%"><span style="font-family:"Arial",sans-serif"></span></span></span></span></span></span></span></div> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><span dir="LTR" style="line-height:90%"><span style="font-family:"Arial",sans-serif"></span></span></span></span></span></span></span><br> &nbsp; <div style="text-align: justify;"><span style="font-size:11pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Background: </span></b>Conventional thinking about &quot;accountability&quot; should be expanded beyond the mere attribution of malicious acts and punishment of perpetrators, and political and sectarian goals should not be the basis of acceptable behavior, but ethics, which is a universal concept, should be the basis of such differentiation. One of the citations for accountability is the civil liability law. Therefore, in this research, the aim was to answer the question that basically, how civil responsibility, which is an important tool in preserving ethics and accountability, is realized in the virtual space, and in this regard, the laws of Iran and Russia were compared.</span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="text-justify:kashida"><span style="text-kashida:0%"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b>Conclusion</b>: Considering the importance of accountability from all levels in the virtual space, the civil liability law can be used to some extent to make people accountable in this area.
