fa رویکردهای اخلاقی در مثنوی مولوی با رویکرد به مبانی قانون جذب Ethical Foundations in the Implementation of Women's Criminal Sentences from the Perspective of Iranian Jurisprudence and Law تخصصي Special مروری Review Article <div style="text-align: justify;">زمینه: یکی از موضوعاتی که از سوی پژوهشگران در دهههای گذشته مورد نظر قرار گرفته، مسائل مربوط به قانون جذب است. در گسترۀ شعر و ادب فارسی نیز، به سویههایی از این قانون اشاره شده است. در این بین میتوان به مولوی اشاره کرده که در اثنای مثنوی معنوی بارها به مبانی این قانون پرداخته و با تکیه بر آن، شماری از آموزههای اخلاقی را در سرودۀ خود بازتاب داده است. این رویکرد مولوی بدیهی به نظر میرسد؛ زیرا او از شاخصهها و عناصر گوناگون استفاده میکند تا  دیدگاههای خود را در زمینههای اخلاقی، شناختی و ... شرح دهد. نتیجه گیری: مولوی با رویکرد به مبانی قانون جذب به آموزههایی چون: «نتیجۀ کار خوب، خوبی و برآیند فعل بد، بدی است»؛ «نکوهش بداندیشی و منفیگرایی»؛ «دعوت به مطلوباندیشی و مثبتگرایی»؛ «بازگشت به هویت اصیل خویش»؛ «دنیاستیزی و فریبنده بودن آن»؛ «اتحادگرایی و پرهیز از تفرقه» اشاره کرده است. شاعر میگوید آدمی بر اساس کنشهایی که انجام میدهد، به نتیجۀ خوب یا بد میرسد. همچنین، توجه به افکار نامطلوب از دید مولوی رد شده و در برابر، نیکاندیشی به دنیای اطراف، توصیه شده است. از نگاه شاعر، هر فرد باید ازخودبیگانگی را به عنوان خطری جدی به حساب آورد و هویت اصلی خویش را طلب کند تا به آرامش برسد. برای رسیدن به این هدف، دوری گزیدن از دنیا و مافیها سودمند خواهد بود. پس از گذر از این مرحله، نه تنها اتحاد درونی حاصل میشود، بلکه تمامی بسترهای تفرقه افکن رنگ میبازد و اتحادی فراگیر نمود پیدا می کند.  </div> <div style="text-align: justify;">Background: In Iranian jurisprudence and law, as there is a relationship between crime and gender, this relationship can also be seen in the implementation of punishment. Therefore, the present research aims to examine the moral foundations of the execution of punishments for women in Iranian laws and to present specific criminal sentences for women in connection with publicity, exile, homosexuality, apostasy, the quality of the execution of the limit, the place of detention of convicts and the delay in punishment in He has paid attention to the special conditions that have been established with regard to ethical principles. Conclusion: One of the important issues and attention of the international community is respect for the rights of men and women and non-discrimination based on gender. The results of the research indicate that in Iranian law, punishment for women has been tried based on the two principles of looking at women's dignity and observing justice. In order to achieve this goal in the field of criminal law, protections for women's rights in the form of cases such as: exemption from paying dowry in cases of pure wrongdoing, delay in the execution of punishment, criminal protection for women in case of alimony and criminal protection for women in Testimony has taken place.
