fa حمایت از اطفال و نوجوانان: وظیفه قانونی و اخلاقی قوه قضاییه تخصصي Special مروری Review Article <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">در راستای حمایت از کودکان و نوجوانان، پس از سال‌ها قانون‌گذاری پراکنده، در سال ١٣٨١ قانون حمایت از اطفال و نوجوانان در قالب ٩ ماده به تصویب رسید. با وجود تمرکز این قانون بر حمایت از اطفال و نوجوانان، نواقص متعددی داشت و پاسخگوی نیازهای موجود نبود. سرانجام در سال ١٣٩٩، شورای نگهبان لایحه جدید حمایت از اطفال و نوجوانان را با ٥١ ماده و ١٥ تبصره تایید کرد. این قانون در مقایسه با قانون قبلی، از نظر تعداد مواد و نوآوری‌های ماهوی و شکلی، پیشرفت قابل توجهی داشته است</span></span><span dir="LTR" style="line-height:90%"><span arial="" style="font-family:">.</span></span><span style="line-height:90%"><span b="" mitra="" style="font-family:"> این مقاله باهدف بررسی وظایف قانونی و اخلاقی قوه قضاییه در حمایت از اطفال و نوجوانان به روش تحلیل توصیفی انجام شده است.</span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">نتیجه گیری:</span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:"> نتایج نشان می‌دهد که قانون جدید آیین دادرسی کیفری نوآوری‌های متعددی از جمله ایجاد دادسرا و دادگاه‌های ویژه اطفال و نوجوانان، سازمان پلیس ویژه اطفال و نوجوانان، نهاد مددکاری اجتماعی و... دارد که بسیاری از آنها در حقوق ایران سابقه نداشته و تحولی نوین در امر دادرسی اطفال و نوجوانان محسوب می‌شود</span></span><span dir="LTR" style="line-height:90%"><span arial="" style="font-family:">.</span></span><span style="line-height:90%"><span b="" mitra="" style="font-family:"> همچنین، قوه قضاییه در قانون جدید با توجه به وظیفه اخلاقی و قانونی خود در حمایت از اطفال و نوجوانان که در قانون اساسی تصریح شده است، سعی در حمایت کیفری از اطفال و نوجوانان، پیشگیری از بزهکاری آنها و احیای حقوق ایشان با همکاری و مطالبه گری از سایر نهادهای مربوطه دارد. اجرای مؤثر این وظایف می‌تواند به برقراری عدالت اجتماعی در مورد این قشر آسیب‌پذیر کمک کند</span></span><span dir="LTR" style="line-height:90%"><span arial="" style="font-family:">.</span></span> <span dir="LTR" style="line-height:90%"><span style="font-family:"Arial",sans-serif"></span></span></span></span></span></span></span><br> <br> &nbsp;</div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">In order to protect children and adolescents, after years of fragmented legislation, in 2002, the law on the protection of children and adolescents was approved in the form of 9 articles. Despite the focus of this law on the protection of children and adolescents, it had several shortcomings and did not meet the existing needs. Finally, in 2019, the Guardian Council approved the new bill for the protection of children and adolescents with 51 articles and 15 notes. Compared to the previous law, this law has made significant progress in terms of the number of materials and substantive and formal innovations. This article aims to investigate the legal and ethical duties of the judiciary in protecting children and adolescents by means of descriptive analysis.</span></span></span></span></span><br> <b><span style="font-size:10.0pt"><span style="line-height:90%"><span new="" roman="" style="font-family:" times="">Conclusion</span></span></span></b><span style="font-size:10.0pt"><span style="line-height:90%"><span new="" roman="" style="font-family:" times="">: The results show that the new Criminal Procedure Code has several innovations, including the establishment of special prosecutors and courts for children and adolescents, a special police organization for children and adolescents, a social work institution, etc., many of which are unprecedented in Iranian law and are considered a new development in the case of children and adolescents. Also, in the new law, the judiciary, considering its moral and legal duty to protect children and adolescents as stipulated in the Constitution, tries to provide criminal protection for children and adolescents, prevent their delinquency, and restore their rights by cooperating with and demanding from other relevant institutions.
