other زوایای اخلاقی و جرم شناختی رانت خواری Moral and Criminological Aspects of Rent-Seeking تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: پدیده رانت خواری، پدیده ای تاریخی است که سابقه طولانی دارد. عنصر اصلی تشکیل دهنده رانت خواری، تبعیض است. و بسته به اینکه این تبعیض، عادلانه و یا ناروا باشد، ارزش گذاری می شود. رانت خواری مبتنی بر تبعیض ناروا، نمونه بارزی از فساد است و فساد در ذهن هر انسان متفکری، به عنوان امری غیر اخلاقی و  ناپسند، شناخته می شود. بر این اساس پژوهش حاضر با روش توصیفی و تحلیلی به بررسی زوایای اخلاقی و جرم شناختی رانت خواری پرداخته است. نتیجه گیری: غالب عوامل بوجود آورنده رانت خواری، از جمله، انحصار منابع طبیعی، ضعف ساختارها و نهادها، تحریم، حاکمیت اقتدارگرا، ضعف فرهنگی، عدم شفافیت و... همگی ریشه در ساختار اخلاقی جامعه دارد. متاسفانه در جامعه ما که فساد اخلاقی نهادینه شده اس،  بدیهی است که رانت خواری، با رشد روزافزون مواجه می شود و به تدریج حوزه های مختلف اقتصادی، سیاسی، اجتماعی، فرهنگی، اداری و... جامعه را تحت تأثیر قرار می دهد. مضافاً رانت خواری به طور کلی، در نظام حقوقی ما تاکنون جرم انگاری نشده است. این در حالی است که از جمله وظایف و اختیارات اصلی حاکمیت ها، مبارزه با فساد است. و جرم انگاری از مهم ترین و حساس ترین، ابزار رسیدن به این هدف است. بنابراین عدم استفاده از چنین ابزاری، برای برخورد و پیشگیری با رانت خواری در نظام حقوقی ایران، محل پرسش است. خصوصاً آنکه نظام حقوقی مبتنی بر اندیشه اسلامی، خود را ملزم می داند که با مظاهر فساد، برخورد نماید.</div> <div style="text-align: justify;">Background: The phenomenon of rent-seeking is a historical phenomenon that has a long history. The main element of rent-seeking is discrimination. And depending on whether this discrimination is fair or unfair, it is valued. Rent-seeking based on unfair discrimination is a clear example of corruption, and corruption is recognized as immoral and disgusting in the mind of every thinking person. Based on this, the present research has investigated the moral and criminological angles of rent-seeking with a descriptive and analytical method. Conclusion: Most of the factors that cause rent-seeking, including natural resource monopoly, weak structures and institutions, sanctions, authoritarian rule, cultural weakness, lack of transparency, etc., are all rooted in the moral structure of society. Unfortunately, in our society where moral corruption has been institutionalized, it is obvious that rent-seeking is facing increasing growth and gradually affects various economic, political, social, cultural, administrative, etc. areas of the society. In addition, rent-seeking in general has not been criminalized in our legal system. At the same time, one of the main duties and powers of governments is fighting corruption. And criminalization is one of the most important and sensitive tools to achieve this goal. Therefore, the non-use of such a tool to deal with and prevent rent-seeking in Iran's legal system is questionable.
