fa ابعاد اخلاقی مسؤلیت مدنی دولت نسبت به آلودگی هوا Investigating the Moral Dimensions of the Government's Civil Responsibility towards Air Pollution تخصصي Special پژوهشي Research زمینه: مسؤلیت یک مؤلفه اخلاقی است. پاسخ‌گویی معمولاً از مسؤلیت ناشی می‌شود که مطابق با آن فرد از لحاظ قانونی در قبال صدمه‌ای که به دیگری وارد کرده است مسؤل می‌باشد. یکی از مهم‌ترین بخش‌های حقوق مدنی، مسؤلیت مدنی است و با توجه به این که هدف اصلی قواعد مسؤلیت مدنی جبران خسارت‌های مادی و معنوی زیان دیده و ترمیم زیان وارده می‌باشد، دولت نیز از این قاعده مستثنی نمی‌باشد. در مقاله حاضر سعی شده است تا ابعاد اخلاقی مسؤلیت مدنی دولت نسبت به آلودگی هوا تشریح می‌شود. نتیجه‌گیری: یکی از تبعات بد که با صنعتی شدن پیش آمد آلودگی هوا و بطور کلی آلودگی زیست محیطی بود. هر گاه چند سبب باعث ایجاد آلودگی در محیط زیست شده باشند سبب نزدیک و بدون واسطه مسئول جبران ضرر است مگر آن که سبب دورتر اقوی باشد. مواردی نیز در خصوص رفع مسئولیت مدنی وجود دارد که باعث معافیت از مسئولیت مدنی می گردد. بطور کلی آنچه اهمیت دارد رفع مصونیت دولت و تحقق مسئولیت مدنی آن جهت جبران خسارت ناشی از آلودگی هوا می باشد که دولت را به پرداخت خسارت و ضرر و زیان وارده یا به واسطه وظیفه تصدی گری و یا نظارتی می کند. البته احراز مسئولیت مدنی دولت در قبال آلودگی محیط زیست امری پیچیده و فرایندی هزار تو است که نیاز به مداقه و تلاش بسیاری دارد اما آنچه مسلم است مسئولیت مدنی دولت در صورت اثبات سببیت می تواند به نسبت خسارت وارد شده احراز و باعث مسئول شناخته شدن دولت در قبال شخص متضرر باشد.   <div style="text-align: justify;">Background: Responsibility is a moral component. Accountability usually stems from liability, according to which a person is legally responsible for the harm they have caused to another. One of the most important parts of civil rights is civil liability, and considering that the main purpose of civil liability rules is to compensate material and spiritual damages and repair the damages, the government is not exempt from this rule. In this article, it has been tried to explain the moral aspects of the government's civil responsibility towards air pollution. Conclusion: One of the bad consequences of industrialization was air pollution and environmental pollution in general. Whenever there are several causes causing pollution in the environment, the immediate and unmediated cause is responsible for compensating the loss, unless the cause is more remote. There are also cases regarding the removal of civil liability, which causes exemption from civil liability. In general, what is important is to remove the government's immunity and fulfill its civil responsibility in order to compensate for the damage caused by air pollution, which makes the government pay for the damages and losses caused either through its administrative or supervisory duties. Of course, verifying the government's civil responsibility for environmental pollution is a complex and multifaceted process that requires a lot of attention and effort, but what is certain is that the government's civil responsibility can be verified in proportion to the damage caused and the government is recognized as responsible if causation is proven. be against a person who has suffered.  </div> ابعاد اخلاقی,مسؤلیت مدنی, دولت, آلودگی هوا, جبران خسارت, محیط زیست.
