fa اخلاق در دادرسی کیفری: حقوق شهروندی از دیدگاه متهم و بزه دیده Ethics in Criminal Proceedings: Citizen's Rights from the Point of View of the Accused and the Victim تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: یکی از مباحث مهم اخلاقی در قانون آیین دادرسی کیفری جدید مربوط به رعایت حقوق شهروندی در مراحل دادرسی است. سنگ بنای یک امر کیفری در مرحله ی کشف جرم توسط ضابطان گذاشته می شود و این مرحله، نقش مهمی در تأمین یا عدم تأمین حقوق شهروندی افراد دارد. در قانون جدید رعایت اخلاق در دادرسی کیفری ابتدا منوط به رعایت حقوق شهروندی است  . در این تحقیق به بررسی حقوق شهروندی  از منظر  متهمان و بزه دیدگان براساس ق. آ. د. ک. 1392 پرداخته شده است. نتیجه گیری: تحقیق نشان می دهد  قانون آیین دادرسی کیفری 1392 در مقایسه با قوانین سابق, نکات ارزشمند بسیاری در راستای تعالی اخلاق و رعایت هرچه بیشتر حقوق شهروندی متهمان و بزه دیدگان در کلیه ی مراحل دادرسی کیفری مخصوصاً در مرحله ی کشف جرم و تحقیقات مقدماتی مقرر کرده و تکالیف ضابطان دادگستری در آن نسبت به قانون سابق از لحاظ کمی, گسترده تر و از لحاظ کیفی دقیق تر و صریح تر و با نوآوری هایی مخصوصاً در حوزه ی رعایت حقوق شهروندی همراه است. به منظور رعایت این حقوق ، تضمین هایی مقرر شده است که تحقق این مهم را در عالم واقع میسر نماید، لذا با مقرر نمودن تضمین های عام و کلی در صدد حمایت از طرفین شکایت کیفری و از سوی دیگر تضمین های متناسب با وضعیت هر یک از طرفین به آنها اختصاص داده است. </div> <div>Background: One of the important ethical issues in the new criminal procedure law is related to the observance of citizen's rights in the proceedings. The foundation stone of a criminal matter is laid by the law enforcement officers in the stage of crime discovery, and this stage plays an important role in securing or not securing people's citizenship rights. In the new law, the observance of ethics in criminal proceedings depends on the observance of citizen's rights. In this research, to investigate the rights of citizens from the perspective of the accused and the victims based on Q. A. D. K. 2012 has been paid. Conclusion: The research shows that the criminal procedure law of 2012, compared to the previous laws, has many valuable points in the direction of improving morals and respecting the citizenship rights of the accused and the victims as much as possible in all stages of criminal proceedings, especially in the stage of crime discovery and preliminary investigations. and the tasks of judicial officers in it are quantitatively broader and qualitatively more precise and explicit than the former law, and are associated with innovations especially in the field of observing citizen rights.
