other نگاهی تحلیلی، حقوقی و اخلاقی به دعوای رفع مزاحمت Analytical, Legal and Ethical Look at Harassment Litigation تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: همزیستی انسانها مستلزم رعایت آداب اخلاقی است که در علم اخلاق از آن تحت عنوان اخلاق مدنی یاد میشود و منجر به نظم هنجاری میشود. برای اینکه اخلاق مدنی ضمانت اجرایی داشته باشد مجموعه قوانینی در جامعه تحت عنوان آیین دادرسی مدنی شکل گرفت. یکی از دعاوی در این رابطه دعوای رفع مزاحمت است. در دعوی رفع مزاحمت مسائل پیچیده ای وجود دارد که قانون آیین دادرسی مدنی به خوبی به آنهاتوجه نکرده است. در این نوشتار سعی شده ضمن توجه به مبحث اخلاق مدنی و قوانین حامی آن، موارد تشابه و تفاوت دعوای رفع مزاحمت از سایر مفاهیم مشابه مورد توجه قرار گرفته و نحوهی اجرای آن در نظام آیین دادرسی مدنی تبیین گردد. نتیجه گیری: اخلاق مدنی ضرورت تمدن شهرنشینی است و با مفاهیم همبستگی اجتماعی و نظم اجتماعی نزدیکی بسیار دارد .  بیشک بدون عنایت به وجدان فردی نمیتوان توقع داشت اخلاق در جامعه مدنی نهادینه شود اما برای برقراری نظم اجتماعی نیاز به قوانین و مقرارتی وجود دارد که ضمانتی اجرایی برای اخلاق مدنی فراهم سازد. نظام آیین دادرسی مدنی شاید راهی است تا اخلاق مدنی را زیر چتر حمایتی قانون قراردهد. در این بین شیوه برخورد آیین دادرسی مدنی با دعوای رفع مزاحمت میتواند به عنوان یک نمونه مورد توجه قرار گیرد. در حقیقت این قانون به بهانه منع احقاق حق شخصی و حفظ نظم هنجاری و عمومی، مبنای حق را تصرف اشخاص قرار داده و در نتیجه، مالکیت اشخاص را مورد تعرض قرار داده است. در چنین شرایطی این احتمال وجود دارد که مالک متصرف، با فقدان سبق تصرف، از تصرف مالکانه خود محروم ماند. در این مورد مشخص شد که آیین دادرسی مدنی کشور برای تضمین نظم هنجاری و صیانت از اخلاق مدنی نیازمند اصلاحات اساسی است.</div> <div style="text-align: justify;">Background: The coexistence of human beings requires the observance of moral etiquette, which is called civil ethics in ethics and leads to normative order. In order for civil ethics to have an executive guarantee, a set of laws was formed in the society under the title of civil procedure. One of the lawsuits in this regard is the harassment lawsuit. There are complex issues in the harassment lawsuit that the Code of Civil Procedure has not addressed well. In this article, while paying attention to the issue of civil ethics and the laws that protect it, the similarities and differences of harassment lawsuits from other similar concepts are considered and the manner of its implementation in the civil procedure system is explained. Conclusion: Civil ethics is a necessity of urban civilization and is very close to the concepts of social solidarity and social order. Of course, without regard to individual conscience, one cannot expect morality to be institutionalized in civil society, but in order to establish social order, there is a need for laws and regulations that provide an executive guarantee for civil morality. The civil procedure system may be a way to bring civil ethics under the protection of the law. In the meantime, the way civil procedure deals with harassment lawsuits can be considered as an example. In fact, this law, under the pretext of forbidding the exercise of personal rights and maintaining normative and public order, has taken the basis of the right of possession of persons and, as a result, has invaded the property of persons. In such circumstances, it is possible that the possessing owner was deprived of his possessive possession due to the lack of a record of possession.
