other جایگاه اخلاقی معاملات سنتی و الکترونیکی در صورت فقدان قصد و رضا The Moral Position of Traditional and Electronic Transactions in the Absence of Intention and Consent تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: با توجه به گسترش روزافزون دنیای الکترونیک در تمامی جوانب، معاملات الکترونیکی جایگاه خود را در کنار معاملات سنتی پیدا کرده و به نوبه خود از اهمیت خاصی برخوردار می باشند و سهم بسزایی در قراردادهای تجاری بر جای نهاده اند. همین امر چالش های اخلاقی مهمی را به دنبال داشته است. معاملات الکترونیک به واسطه مواردی چون فقدان زمینه‌های حقوقی و قانونی لازم ، عدم ساز و کار مناسب برای حمایت از حقوق مصرف‌کنندگان، نبود امنیت لازم برای انجام مبادلات و تبادل اطلاعات و ... زمینه مستعدی برای نقض اصول اخلاقی کسب و کار فراهم نموده است. از این رو پژوهش حاضر بر آن شد تا جایگاه اخلاقی معاملات سنتی و الکترونیکی را در صورت فقدان قصد و رضا که یکی از مبانی اخلاقی مهم در انعقاد قراردادهاست مورد بررسی قرار دهد. نتیجهگیری: با بررسی عوامل فقدان قصد و رضا همچون اشتباه، اکراه و اضطرار که هر یک دارای آثار متفاوت بر عقد از دیدگاه علم اخلاق می باشند، مشخص شد که چون قصد، عنصر سازنده عقد میباشد و رضا تنها شرط اعتبار آن محسوب می شود، عقد در حالت اشتباه موثر در قصد، به جهت فقدان قصد، باطل و عقد در حالت اکراه موثر در رضا، به جهت فقدان رضا، غیرنافذ خواهد بود. با این وجود، اضطرار که امری اخلاقی است تأثیری در معامله ندارد. از حیث ماهوی میان معاملات الکترونیکی و معاملات سنتی تفاوتی وجود ندارد؛ بلکه تنها شیوه انعقاد آن دو با یکدیگر متفاوت است. عوامل گفته شده در معاملات الکترونیکی نیز صدق میکند</div> <div style="text-align: justify;">Background: Due to the increasing expansion of the electronic world in all aspects, e-commerce has found its place alongside traditional transactions and in turn are of particular importance and have left a significant share in commercial contracts. This has led to significant ethical challenges. E-commerce, due to the lack of necessary legal and legal grounds, lack of proper mechanism to protect consumer rights, lack of necessary security for exchanges and exchange of information, etc., has provided a potential ground for violating business ethics. Therefore, the present study decided to examine the moral status of traditional and electronic transactions in the absence of intention and consent, which is one of the important ethical principles in concluding contracts. Conclusion: By examining the factors of lack of intention and consent such as error, reluctance and urgency, each of which has different effects on the contract from the point of view of ethics, it became clear that because intention is the constructive element of the contract and consent is the only condition for its validity. It is considered that the contract will be ineffective in the case of intentional ineffectiveness, in the absence of intention, and the contract will be ineffective in the case of reluctance in the case of reluctance, in the absence of consent. However, urgency, which is moral, has no effect on the transaction. In essence, there is no difference between e-commerce and traditional trading; It's just that the two are different.
