Background: The right to health is one of the dimensions of human rights, which is considered necessary for fulfilling other human rights. The right to health means that everyone has the right to achieve the highest standard of physical and mental health. Children are one of the groups of society that pay special attention to their physical and mental health. Governments are obliged to provide the possibility of a healthy life for children, and for this they need to adjust the laws to the children's conditions. One of the fields that need special discriminatory laws in this regard is the field of criminal law. Today, it is emphasized that a different procedure is applied to crimes committed by children compared to what is customary for adults. This approach, which is referred to as differential criminal proceedings, has components and requirements that are all based on camaraderie, reduction of strictness, approach to the future, reform-oriented and treatment-oriented, and rehabilitative vision. In this article, ethics and the right to children's health are examined from the perspective of criminal law and differential proceedings. Conclusion: Iran has recognized and supported the right to health by approving various laws and regulations in the field of health as well as joining various international conventions. And in criminal law, he has compiled the laws that are considered for the punishment of children and teenagers and the way to rehabilitate and reform them according to this right.
